Peter R. vermoordde na een avondje stappen de vrouw van zijn voormalige werkgever. Wilhelm S. ontsnapte aan zijn bewakers en vermoordde een 73 jarige Amsterdammer en Michael S. verkrachtte op proefverlof een 13 jarig meisje. Peter R., Wilhelm S. en Michael S. waren toen zij hun misdaden pleegden veroordeeld tot TBS. Deze dwangbehandeling moest voorkomen dat ze opnieuw de fout ingingen. Maar het ging mis. En dat gebeurt vaker. Van de TBS’ers die tegen de zin van de kliniek vrij komen begaat 40 % binnen 10 jaar weer een ernstig misdrijf. Van de TBS’ers die vrij komen met instemming van de kliniek is dat ook nog één op de vier. Van de eerste groep begaat een op de vijf zelfs een zeer ernstig misdrijf zoals een moord waarop een gevangenisstraf staat van 8 jaar of meer. Van de tweede groep is dat een op de twintig. Het is niet verbazingwekkend dat TBS’ers op weinig sympathie kunnen rekenen. Na elk drama klinkt de roep om een strenger regime voor deze monsters.

Voor onbepaalde tijd

Maar deze roep om een strenger regime voor TBS’ers begint averechts te werken. Het hele systeem dreigt te imploderen. Instellingen zijn voorzichtiger met proefverloven en geven veel minder makkelijk hun toestemming voor vrijlating. De gemiddelde duur van een TBS behandeling is gestegen van gemiddeld 4,5 jaar naar 7 jaar. Inmiddels zijn er 200 TBS’ers die nooit meer vrij komen. Ze zitten op een zogenaamde long stay afdeling. Volgens advocaat Willem Anker is dat één op de acht TBS’ers. Het is de vraag of al die 200 patienten inderdaad hopeloze gevallen zijn. Enkele jaren geleden interviewde ik een ex-TBS’er die onder de naam Ludwig Humphrey het boek Onder Dwang had geschreven. Ludwig had zijn vriendin vermoord. Hij vertelde dat het personeel een verbanning naar de long stay afdeling gebruikte als dreigement tegen lastige patiënten.

Een bedreiging met een aardappelschilmesje

Nu zal het de gemiddelde burger worst wezen of sommige TBS’ers onterecht op een long stay afdeling zitten. Met zulke monsters hebben zij geen enkel medelijden. Dat komt omdat iedereen bij TBS’ers denkt aan moordenaars en verkrachters. Maar er is ook nog een andere categorie mensen die een veroordeling krijgen. Onlangs vertelde Josina de Vormer in De Volkskrant (13 juni 2008) over de TBS van haar dochter. Haar dochter heeft een psycholoog bedreigd met een aardappelmesje. Haar dochter is een zware borderliner. Maar in de TBS kliniek krijgt ze vanwege personeelstekort nauwelijks behandeling. En vanwege gebrek aan behandeling wordt het verblijf steeds verlengd. Op bedreiging staat een maximale gevangenisstraf van 4 jaar. Haar dochter zit al 6 jaar in de TBS-kliniek.
Van misdadigers met psychiatrische problemen wordt gezegd dat zij verminderd toerekeningsvatbaar zijn. Hun psychiatrische problemen werden ooit aangevoerd als een verzachtende omstandigheid. Inmiddels zijn die psychische kwalen eerder een verzwarende omstandigheid. Mensen krijgen niet een lagere straf omdat hun daden voortkwamen uit dwangmatig gedrag. Integendeel. Zij worden langer opgesloten omdat hun psychiatrische kwaal de kans op recidive vergroot. De advocaat Lucy Oldenburg heeft recentelijk twee verkrachters naast elkaar gezet. De een is veroordeeld tot 18 maanden cel. De ander zit al 9 jaar vast met TBS. Voor criminelen is een veroordeling tot TBS niet meer een kans op genezing, maar een risico om nooit meer vrij te komen. Veel advocaten adviseren hun cliënten om niet mee te werken aan psychologisch onderzoek. Een veroordeling tot dwangverpleging is dan weliswaar nog steeds mogelijk, maar de kans daarop is wel veel kleiner. Vanuit het perspectief van de veroordeelde is dit advies begrijpelijk, maar voor de samenleving is deze ontwikkeling desastreus.

Gewone gevangenen

Het betekent dat mensen als Peter R., Wilhelm S. en Michael S. in de toekomst zullen proberen te ontkomen aan TBS. Het betekent dat zij na een gevangenisstraf van een aantal jaren onbehandeld op vrije voeten zullen komen. Het aantal TBS’ers dat opnieuw de fout in gaat zal op deze manier aanmerkelijk dalen, want er komen dan nauwelijks TBS’ers vrij. Maar helaas maakt dat de samenleving niet veiliger. Het zijn dan ‘gewone’ gevangenen die opnieuw de fout in gaan. Het is tijd om over onze schaduw heen te springen. Uit angst om levenslang te worden opgeborgen gaan mensen die behandeling nodig hebben, proberen die behandeling te ontlopen. Het resultaat van onze harde opstelling tegen TBS’ers zal daarom eerder zijn dat er meer voormalige werkgevers en bejaarde Amsterdammers worden vermoord en meer 13 jarige meisjes worden verkracht. Want de behandeling in de TBS is verre van optimaal, maar zonder behandeling zijn gekken als Peter R., Wilhelm S. en Michael S. nog veel gevaarlijker.
